The Commission then stayed the suspension in its entirety upon certain conditions. The Commission found that Flores listed the subject property and advertised it as containing 2,538 square feet of heated living area. However, this figure improperly included approximately 756 square feet of unpermitted living space in an apartment above the garage that was not directly accessible from the main living area. The septic permit for the subject property authorized only three (3) bedrooms; however, Flores failed to disclose, prior to the submission of the offer, that two (2) additional bedrooms were connected to the same septic system.
